On Tuesday, December 14, 2021, the High Court issued an arrest warrant against Directorate of Criminal Investigations (DCI) boss George Kinoti over contempt of court.
The warrant of arrest was issued following a court case where Kinoti is accused of failing to return seven firearms to businessman Jimi Wanjigi as had been ordered by the court.
However, the arrest warrant refers to a court order issued in 2019, where Kinoti was ordered to return the guns to Jimi Wajingi
“Whereas Mr George Maingi Kinoti has this day been charged before this court for contempt of court order pursuant to an order issued by Hon. Justice Mwita on the 21st June 2019,” reads the order.
Kinoti, at that time, claimed that he had not been given time and opportunity to be heard by the court before the order was issued.
At the time of the case, Wanjigi had his firearm licence revoked three times, the latest being on January 30, 2018, when his civilian firearm certificate was revoked for the third time. He was ordered to surrender immediately the firearm certificate, all firearms and ammunition in his possession.
On February 6, 2018, Wanjigi through his advocate averred that all his firearms and ammunition were confiscated from his residence on October 17, 2017, and therefore he had nothing more to surrender.
Since then, Wanjigi has never renewed his firearm licence, despite concerted efforts to regain his firearms, some of which are not legal for civilians.
Kinoti was in November sentenced to four months in prison for contempt of court after failing to comply with court orders to return firearms seized from Wanjigi.
The arrest warrant issued on Tuesday gives an opportunity to Kinoti to defend himself in the case dating back to 2019, something that could land Wanjigi in trouble.
“Therefore you are hereby commanded to apprehend the said Mr. George Maingi Kinoti and to bring him before this court to answer to the said charge and to be further dealt with according to law,” the court order issued on Tuesday reads.
Seemingly, the court has set aside the court ruling sentencing Kinoti to jail, and instead opted to listen to him, regarding the saga.
In his latest application, Kinoti has asked the Court of Appeal to block his arrest, saying Jimi Wanjigi and wife are harassing him.
