A Nairobi court has directed the prosecution to furnish the defense team with statements from President Uhuru Kenyatta and Raila Odinga in a case where two IT Managers previously working with Sarova Stanley are accused of leaking CCTV footage of the two in the CBD.
Trial Magistrate Bernard Ochoi on Tuesday directed the case be mentioned on October 29, 2020 for further directions.
The accused; Patrick Rading Ambogo and Magoma Ayonga, were charged with the offence of unauthorized interception of computer data contrary to section 17(1) of the Computer Misuse and Cyber Crime Act.
Through their lawyer, Danstan Omari, the two argued that the charge does not exist in law.
In July, the court gave the prosecution seven days to record statements from President Kenyatta and Raila – alleged complainants in the case.
“We had requested statements from the President and Raila who were alleged to have been in the entourage but to date, those statements have not come,” Omari had told the court.
The two were released on Sh10,000 bail or Sh300,000 bond, each.
